AGREEMENT TO OUR LEGAL TERMS
We are Ann Kottler Home LLC ("Company," "we," "us," "our"), a company registered in Wisconsin, United States at 1061 Lakeland Lane, Lake Geneva, WI 53147.
We operate the website http://www.annkottlerhome.com (the "Site"), as well as related services provided through the Site (the "Legal Terms") (collectively, the "Services").
We provide interior design services, including new construction, remodeling, furnishings, and styling services.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Ann Kottler Home LLC, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. If you do not agree to these Legal Terms, you should not access or use the Services.
Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time. We will alert you about any changes by updating the "Last updated" date of these Legal Terms. It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted.
The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use the Services.

1. OUR SERVICES
The Services are provided for general informational purposes and to describe the interior design services offered by the Company. We make no representation that the Services are appropriate or available for use in all jurisdictions, and those who access the Services from outside the United States do so at their own initiative and are responsible for compliance with applicable local laws. YThe Services do not constitute architectural, engineering, construction, or other licensed professional advice, and any reliance on the information provided through the Services is at your own risk.
2. INTELLECTUAL PROPERTY RIGHTS
Our intellectual property
We are the owner or the licensee of all intellectual property rights in our Services, including all website designs, text, photographs, and graphics in the Services (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks").
Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) and treaties in the United States and around the world.
The Content and Marks are provided in or through the Services "AS IS" for your personal, non-commercial use only.
Your use of our Services
Subject to your compliance with these Legal Terms, including the "PROHIBITED ACTIVITIES" section below, we grant you a non-exclusive, non-transferable, revocable license to:

download or print a copy of any portion of the Content to which you have properly gained access,
solely for your personal, non-commercial use.

User Communications
If you provide us with feedback, suggestions, or other communications regarding our Services, you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use and incorporate such feedback for any lawful purpose without compensation to you.
Your Responsibilites
You agree not to submit or transmit any unlawful, infringing, or harmful content through the Services and acknowledge that you are responsible for your communications with us.
3. USER REPRESENTATIONS
By using the Services, you represent and warrant that: (1) you have the legal capacity and you agree to comply with these Legal Terms; (2) you are not a minor in the jurisdiction in which you reside; (3) you will not access the Services through automated or non-human means, whether through a bot, script or otherwise; (4) you will not use the Services for any illegal or unauthorized purpose; and (5) your use of the Services will not violate any applicable law or regulation.
If you provide any information to us that is untrue, inaccurate, not current, or incomplete, we reserve the right to suspend to terminate your access to the Services and refuse any current or future use of the Services (or any portion thereof).
4. PURCHASES AND PAYMENT
We accept the following forms of payment:

If you make a purchase through the Services, you agree to provide current, complete, and accurate payment and contact information. Payment methods accepted may vary and will be presented at the time of purchase or invoicing.
You agree to promptly update your information as necessary so that we can complete transactions and communicate with you. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in US dollars.
You agree to pay all charges at the prices in effect at the time of purchase or as set forth in any applicable agreement, proposal, or invoice.
Payments may be processed through third-party payment processors, and we do not store full payment card information.
We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.
We reserve the right to refuse or cancel any order or request for services at our discretion. 5. POLICY
All payments are non-refundable except as required by applicable law or as otherwise agreed in writing.
Certain services may be subject to separate agreements, proposals, or contracts which will govern cancellation, refund, or rescheduling terms.
6. PROHIBITED ACTIVITIES
You may not access or use the Services for any purpose other than that for which we make the Services available. You agree not to use the Services in any unlawful manner or in a way that could damage, disable, overburden, or impair the Services.
As a user of the Services, you agree not to:
Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
Circumvent, disable, or otherwise interfere with security-related features of the Services.
Use the Services in a manner inconsistent with any applicable laws or regulations.
Engage in unauthorized framing of or linking to the Services.
Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party's uninterrupted use and enjoyment of the Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services.
Delete the copyright or other proprietary rights notice from any Content.
Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services.
Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Services to you.
Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services.
7. USER GENERATED CONTRIBUTIONS
The Services do not provide functionality for users to publicly post or share content. However, you may communicate with us directly (for example, via contact forms, email, or other communications).
You agree that any information or materials you provide to us will be lawful and will not infringe the rights of any third party.
Any misuse of the Services may result in termination of your access to the Services.
8. CONTRIBUTION LICENSE
You and we agree that we may access, store, process, and use any information and personal data that you provide in accordance with our Privacy Policy and your applicable choices.
By submitting suggestions or other feedback regarding the Services, you agree that we can use such feedback for any purpose without compensation to you.
Any information you provide must be lawful and must not infringe the rights of any third party.
9. GUIDELINES FOR REVIEWS
The Services do not currently provide functionality for users to post public reviews or ratings. If you provide testimonials or feedback directly to us, you agree that such information may be used in accordance with our Privacy Policy and with your consent where required by law.
10. SERVICES MANAGEMENT
We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who violates the law or these Legal Terms, including without limitation, reporting such user to law enforcement authorities; (3) refuse, restrict access to, limit the availability of the Services; and (5) otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.

By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms. Please be advised the Services are hosted in the United States. If you access the Services from outside the United States, you acknowledge that your information may be transferred to, stored, and processed in the United States, subject to appropriate safeguards as required by applicable law.
12. TERM AND TERMINATION
These Legal Terms shall remain in full force and effect while you use the Services.
We reserve the right, in our reasonable discretion, to suspend or terminate your access to the Services if you violate these Legal Terms or applicable law.
We may also suspend or restrict access to the Services as necessary to protect our rights, property, or the proper functioning of the Services.
We reserve the right to take appropriate legal action in response to violations of these Legal Terms, including seeking remedies available under applicable law.
13. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, or remove the contents of the Services at any time at our discretion with or without notice. However, we have no obligation to update any information on our Services. To the fullest extent permitted by applicable law, we will not be liable for any modification, suspension, or discontinuance of the Services.

We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Services at any time with or without notice to you. To the fullest extent permitted by law, we disclaim liability for any loss or inconvenience caused by any interruption or unavailability by the Services. Nothing in these Legal Terms will be construed to obligate us to maintain and support the Services or to supply any corrections, updates, or releases in connection therewith.
14. GOVERNING LAW
These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Wisconsin applicable to agreements made and to be entirely performed within the State of Wisconsin, without regard to its conflict of law principles.
15. DISPUTE RESOLUTION
Informal Negotiations
To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms (each a "Dispute" and collectively, the "Disputes") brought by either you or us (individually, a "Party" and collectively, the "Parties"), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.
Resolution of Disputes
If the Parties are unable to resolve a Dispute through informal negotiations, either Party may pursue the Dispute in a court of competent jurisdiction, subject to the governing law and venue provisions set forth in these Legal Terms. Class Action Waiver
To the fullest extent permitted by law, you agree that any Dispute shall be brought on an individual basis and not as part of any class, consolidated, or representative action. Time Limitation
Any claim or cause of action arising out of or relating to the Services must be commenced within one (1) year after the cause of action arises, to the extent permitted by applicable law.
Equitable Relief
Nothing in this section shall prevent either Party from seeking injunctive or other equitable relief in a court of competent jurisdiction, particularly in connection with the protection of intellectual property or confidential information.
16. CORRECTIONS
There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, with or without notice.
17. DISCLAIMER
The Services are provided on an “as-is” and “as-available” basis. Your use of the Services is at your own risk.
To the fullest extent permitted by applicable law, Ann Kottler Home LLC disclaims all warranties, express or implied, in connection with the Services and your use of them, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We make no warranties or representations about the accuracy, completeness, or reliability of any content provided through the Services or any third-party websites linked to the Services.
To the fullest extent permitted by law, we assume no liability or responsibility for:
any errors, mistakes, or inaccuracies in content or materials;
any personal injury or property damage resulting from your use of or reliance on the Services;
any unauthorized access to or use of our systems or any personal information stored therein;
any interruption or cessation of the Services;
any bugs, viruses, or other harmful components transmitted through the Services by any third party; or
any loss or damage incurred as a result of the use of the Services or reliance on any information provided.

The Services are intended for general informational and marketing purposes only and do not constitute architectural, engineering, construction, or other licensed professional advice. You are responsible for verifying all information and consulting appropriate professionals where necessary. Any reliance on the Services is at your own risk.
18. LIMITATIONS OF LIABILITY
To the fullest extent permitted by applicable law, Ann Kottler Home LLC and its directors, employees, and agents will not be liable to you or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages, including, without limitation, lost profits, lost revenue, loss of data, or other damages arising out of or relating to your use of, or inability to use, the Services, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability to you for any claims arising out of or relating to the Services, regardless of the form of the action, will be limited to the lesser of:
the amount you have paid to us, if any, during the six (6) months prior to the event giving rise to the claim; or
$100.00 USD.
Nothing in these Legal Terms shall exclude or limit liability to the extent such exclusion or limitation is not permitted under applicable law. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
19. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Ann Kottler Home LLC and its affiliates, and their respective officers, agents, and employees, from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
your use of the Services in violation of these Legal Terms or applicable law;
your breach of these Legal Terms; or
your violation of any third-party rights, including intellectual property rights.
We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with us in the defense of such claims. We will use reasonable efforts to notify you of any such claim.

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications from us.
You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, including via email and through the Services, satisfy any legal requirement that such communications be in writing.
You agree to the use of electronic signatures, contracts, and other records, and to the electronic delivery of notices, policies, and records of transactions initiated or completed by us or through the Services.
To the fullest extent permitted by applicable law, you waive any rights or requirements under applicable laws that require an original (non-electronic) signature or the retention or delivery of non-electronic records.

If any complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by telephone at (800) 952-5210 or (916) 445-1254.
This provision applies only to California residents where required by applicable law.
23. MISCELLANEOUS
These Legal Terms and any policies or operating rules posted by us on the Services constitutes the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. These Legal Terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Legal Terms and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Legal Terms or use of the Services. These Legal Terms will be interpreted in accordance with applicable law without regard to any presumption or rule requiring construction against the drafting party.
